EU Article 10a 2026: Orthopedic Device Supply-Interruption Planning for Distributors
Share
In April 2026, the European Commission updated its questions and answers and decision tree concerning Article 10a—the obligation to inform about interruption or discontinuation of supply for certain medical devices. Orthopedic businesses should understand the issue without assuming that every delay or every product automatically falls within the same notification duty.
What the 2026 update addresses
The Commission’s medical-device guidance index lists the April 2026 revision and decision tree under Article 10a. The framework concerns specified interruption or discontinuation situations and the relevant manufacturer and supply-chain communications.
Build a documented notification process
A manufacturer should be able to identify the affected device, reference, market, economic operators, expected interruption date, reason, estimated duration, available inventory and possible alternatives. Distributors need defined contacts and escalation routes so material information does not remain in an informal message thread.
Distinguish commercial delay from regulatory notification
A coating delay, custom-box approval or temporary shortage of one component may affect delivery without necessarily triggering Article 10a. Conversely, a qualifying supply interruption should not be handled only as a routine sales update. The applicable criteria and reporting route must be assessed by the responsible economic operator.
Information distributors should maintain
Maintain approved product references, destination markets, customer contacts, open orders, inventory, forecast demand, component dependencies, alternative configurations and change-control status. For instrument sets, record which exact component creates the supply risk and whether any proposed substitute requires fresh approval.
ORTHOSURGI continuity planning
When requesting orthopedic instruments, trauma fixation products or spinal-system instruments, provide the required references and forecast quantities. For custom programs, our OEM page explains available development options. A model-specific quotation should state confirmed and pending lead-time elements separately.
This article provides general supply-chain information and does not determine whether Article 10a applies to a particular device or interruption.
